Agreement to Terms

By accessing or using CreatorHarvest ("the Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you may not access the Platform. These Terms apply to all visitors, users, creators, businesses, and others who access or use the Platform.

Definitions

• "Platform" refers to the CreatorHarvest website, applications, and services.
• "Creator" refers to individuals who create content and offer promotional services through the Platform.
• "Business" refers to companies, organizations, or individuals seeking to hire Creators for marketing services.
• "Campaign" refers to a marketing project posted by a Business for Creators to apply to.
• "Content" refers to text, images, videos, and other materials created or shared through the Platform.

Account Terms

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account and password
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring you are at least 18 years old to use the Platform

Terms for Businesses

As a Business using CreatorHarvest, you agree to:

• Provide accurate and complete information about your business and campaigns
• Pay Creators fairly and promptly for completed work
• Use the escrow payment system for all campaign payments
• Approve or request reasonable revisions to content within 7 days
• Not solicit Creators outside the Platform to avoid fees
• Comply with all applicable advertising and disclosure laws

Terms for Creators

As a Creator using CreatorHarvest, you agree to:

• Provide accurate information about your social media presence and audience
• Create original, authentic content that meets campaign requirements
• Deliver content within agreed-upon timelines
• Disclose sponsored content as required by FTC guidelines
• Not artificially inflate followers, engagement, or metrics
• Maintain professional communication with Businesses

Payment Terms

All payments on CreatorHarvest are processed through our secure escrow system:

• Businesses fund campaigns before work begins
• Funds are held in escrow until content is approved
• Creators receive payment within 3-5 business days of approval
• Platform fee of 15% applies to all transactions (waived for founding members' first 3 months)
• Disputes are resolved through our mediation process

Intellectual Property

Creators retain ownership of their original content. By completing a campaign, Creators grant Businesses a non-exclusive license to use the content for the purposes specified in the campaign brief. The Platform and its original content, features, and functionality are owned by CreatorHarvest and are protected by copyright, trademark, and other intellectual property laws.

Prohibited Activities

You may not use the Platform to:

• Violate any laws, regulations, or third-party rights
• Post false, misleading, or deceptive content
• Use fake accounts, bots, or artificial engagement
• Harass, abuse, or harm other users
• Circumvent fees by conducting transactions outside the Platform
• Scrape, collect, or harvest user data
• Interfere with the Platform's security or functionality

Termination

We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms or for any reason at our sole discretion. Upon termination, your right to use the Platform will immediately cease. All pending payments for completed work will still be processed according to our payment terms.

Disclaimers

The Platform is provided "as is" without warranties of any kind. We do not guarantee any specific results from campaigns. We are not responsible for the actions of Creators or Businesses, the quality of content, or the success of marketing campaigns. Users engage with each other at their own risk.

Limitation of Liability

CreatorHarvest shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms will be resolved in the courts located in Sacramento County, California.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Platform after changes constitutes acceptance of the new Terms.
